Acceptable Use Policy
Rules governing responsible and lawful use of the MOBITELSMS carrier platform to protect all users, message recipients, and the telecom ecosystem.

01 Purpose
This Acceptable Use Policy ("AUP") governs all use of the MOBITELSMS platform, including SMS/SMPP messaging, VoIP services, RCS, mobile core, and all associated APIs and tooling. It applies to all customers, their authorised users, and any traffic routed through the platform.
The purpose of this AUP is to protect the integrity of the MOBITELSMS network, ensure compliance with applicable laws and industry regulations, and maintain the trust of message recipients, end users, and the broader telecommunications ecosystem. This AUP is incorporated by reference into the Terms of Service. Effective date: 1 January 2026.
02 Prohibited Content
You may not use the platform to transmit, distribute, or facilitate any of the following types of content:
- Spam — unsolicited bulk messages sent without prior express consent from recipients.
- Phishing — messages designed to deceive recipients into disclosing credentials, financial data, or personal information.
- Fraudulent caller ID — presenting a caller ID that does not belong to you without proper STIR/SHAKEN attestation or legal authority.
- Child sexual abuse material (CSAM) — any content that sexually exploits minors. This will be reported to the relevant authorities immediately.
- Malware and malicious code — links, attachments, or payloads designed to infect devices or compromise systems.
- Deceptive marketing — false claims, misleading offers, or bait-and-switch communications.
- Lottery and prize scams — messages claiming false prizes, inheritances, or windfalls.
- Illegal gambling promotions — in jurisdictions where such promotions are prohibited by law.
Any content that violates this section may result in immediate traffic suspension without notice and referral to law enforcement or regulatory authorities.
03 Prohibited Activities
The following activities are strictly prohibited on the platform:
- Traffic pumping / access stimulation — artificially generating call volume to inflate termination revenue or to exploit interconnect settlements.
- SIM-box fraud — routing international traffic through locally-inserted SIMs to bypass carrier rates or licensing requirements.
- Grey route SMS — routing A2P SMS via P2P routes to avoid delivery restrictions or termination fees.
- CLI spoofing without authorisation — presenting caller line identification you do not hold the right to use under applicable law and STIR/SHAKEN requirements.
- Denial-of-service attacks — sending traffic intended to overwhelm or disable any system, network, or service.
- Bypassing rate limits — deliberately circumventing platform-level throughput controls via multiple sessions, accounts, or IP addresses.
- Accessing other customers' data — any attempt to read, modify, or interfere with data belonging to other platform customers.
- Unauthorised resale — providing platform access to third parties without a signed Reseller Agreement with MOBITELSMS.
04 Messaging Compliance
All A2P (application-to-person) messaging must comply with the regulations of the destination country. For US A2P SMS traffic specifically:
- All A2P SMS traffic to US numbers must be registered via The Campaign Registry (TCR) with approved brand and campaign registrations under the CTIA 10DLC framework before traffic is permitted.
- All opt-out requests — including STOP, UNSUBSCRIBE, CANCEL, END, and QUIT keywords — must be honoured within 24 hours. Opt-out suppression lists must be maintained and respected.
- Every message must clearly identify the sending entity. Anonymous or misleadingly attributed messages are prohibited.
- No unsolicited marketing messages may be sent. Prior express written consent (PEWC) must be obtained for marketing content as required by the TCPA and CTIA guidelines.
- Message content must match the approved campaign use case registered with TCR.
05 Voice Compliance
All outbound voice traffic routed through the platform must comply with applicable laws and regulations in the originating and terminating jurisdictions:
- All outbound voice calls must comply with STIR/SHAKEN attestation requirements (RFC 8224/8225). Calls where attestation is not possible must be appropriately labelled.
- Robocalling, autodiallers, or pre-recorded voice messages to consumers without prior express consent are prohibited, in accordance with the TCPA and equivalent legislation in other jurisdictions.
- Do-Not-Call (DNC) lists must be suppressed before any outbound calling campaign. Federal and state DNC registries must be respected.
- Call recordings made through the platform must comply with all applicable recording consent laws in the relevant jurisdictions.
06 Rate Limits
The platform enforces throughput controls at the account, gateway, and global level to maintain service quality for all customers. You agree to:
- Operate within the TPS (transactions per second) limits specified in your plan or gateway configuration.
- Not deliberately circumvent platform-level rate controls via multiple SMPP connections, parallel API sessions, or multiple accounts.
- Contact support to request a throughput limit increase before intentionally exceeding your current limits.
Sustained throughput above your contracted limits may result in automated traffic throttling or temporary suspension of excess traffic without advance notice.
07 Monitoring and Enforcement
MOBITELSMS monitors platform traffic for AUP violations using automated systems and manual review. We reserve the right to take enforcement action at our sole discretion:
Warning
Written notice for first-time or minor violations, with a remediation deadline.
Traffic Suspension
Immediate suspension of specific traffic types, routes, or services pending investigation.
Account Termination
Immediate termination for serious, repeated, or wilful violations, with no refund of prepaid fees.
Regulatory Reporting
Mandatory reporting to FCC, law enforcement, or other regulatory bodies as required by law.
We will use reasonable efforts to notify you of enforcement action where legally permissible to do so. However, for severe violations (including CSAM, active fraud, or security threats), action may be taken without prior notice.
08 Reporting Violations
If you become aware of suspected AUP violations — whether by another customer, a third party abusing your API credentials, or any other party — please report it promptly:

All abuse reports are treated confidentially. We aim to acknowledge abuse reports within 4 hours and take initial action within 24 hours where appropriate. You may also report suspected CSAM directly to the National Center for Missing and Exploited Children (NCMEC) CyberTipline.
09 Changes to This AUP
We may update this AUP at any time to reflect changes in applicable law, regulatory guidance, industry standards, or observed abuse patterns. Material changes will be communicated to registered account holders via email. The updated AUP will be published at this URL with a revised effective date. Continued use of the platform after the effective date constitutes acceptance of the updated policy.
